Terms of use.

1. Agreement
These terms form a binding agreement between you and TradeInTune (operated from Australia). By creating an account or using the site, you accept these terms. If you do not accept them, do not use the service.
2. Eligibility
You must be at least 13 years old to use TradeInTune.
If you are under 18, you may only use TradeInTune with the permission of a parent or guardian. That parent or guardian must accept these terms on your behalf, and is responsible for supervising your use of the service and for any purchase made on your account.
You must be legally able to enter into a contract under the laws of the country you live in, or have a parent or guardian who is and who does so on your behalf. You must not be barred from using the service under any applicable law or sanctions list.
3. Your account
You are responsible for keeping your login credentials secure. Do not share your account. If you believe someone has gained access, change your password and contact us.
You must give us accurate information when you sign up. We may suspend or close accounts that use false information, that are shared between users, or that are used to abuse the platform.
4. What TradeInTune is (and isn't)
TradeInTune is an educational platform. It teaches a discretionary trading system through interactive lessons, drills, and reference material. The founder also trades the system live with real capital.
TradeInTune is not financial advice. Nothing on the site is personalised to your situation. We are not your broker, your adviser, or your fiduciary. Before you trade real money, you should do your own research and, if needed, speak to a licensed professional in your jurisdiction.
Past performance does not guarantee future performance. Trading involves substantial risk and is not suitable for every investor. You could lose more than you deposit.

5. Subscriptions and payments
Parts of the curriculum are free. Full access is a paid subscription. Pricing is shown on the pricing page. Prices are in the currency displayed at checkout and include applicable taxes where required.
- Subscriptions renew automatically until cancelled.
- You can cancel at any time from your account. You keep access until the end of the current billing period.
- All sales are final. Because you get immediate, full access to the entire curriculum the moment you subscribe, we do not offer refunds once a subscription has started, except where a refund is required by law. See our Return Policy for the detail.
- If you subscribed through the Apple App Store, your purchase is billed by Apple, and any refund is issued by Apple under Apple's own policy — we are not able to issue or override an App Store refund directly. Request one at reportaproblem.apple.com, on your device via Settings → [your name] → Subscriptions, or through Apple Support.
- We may change pricing for future billing periods. We will give you at least 30 days notice by email before a price change applies to your account.
- If you are a consumer in the European Union, the EEA, or the United Kingdom, you have a statutory 14-day right of withdrawal under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013. Where that right applies, it applies regardless of the all-sales-final policy above. Email support@tradeintune.com to invoke it. Note that for digital course content, the cooling-off right may be lost once you start consuming the content if you have given prior express consent. We will not deny a refund on that basis without first telling you which consent you gave.
6. Acceptable use
When you use our social features — public profiles, friends, comments, reactions, and the leaderboard — you must follow our Community Guidelines. You also agree not to:
- Scrape, copy, or redistribute the curriculum, drill content, or any other proprietary material.
- Share your account or resell access to other people.
- Reverse engineer, decompile, or attempt to extract source code from the product.
- Use the service to harm, harass, or deceive other users.
- Upload malware, probe for vulnerabilities without written authorisation, or interfere with the normal operation of the site.
- Use automated means (bots, scripts, headless browsers) to access the platform beyond what public APIs allow.
If you find a security issue and report it in good faith, we will not pursue you. Email security@tradeintune.com.
7. Intellectual property
All course content, written material, visual assets, software, and branding on TradeInTune are owned by TradeInTune or licensed to us. You are granted a personal, non-exclusive, non-transferable licence to access and use that content for your own education while your account is active.
You keep ownership of anything you submit to us (support messages, journal entries, feedback). By submitting, you grant us a licence to use that submission for the purpose of running and improving the service.
We take our intellectual property seriously and we enforce it. If you copy, reproduce, redistribute, resell, or pirate our content or IP without authorisation, you are in breach of these terms and of copyright law. Unauthorised reproduction or distribution of our copyrighted material will be pursued to the fullest extent of the law: we will take legal action against offenders, including seeking injunctions, damages, and recovery of our legal costs.
8. User content and copyright
You may submit limited content to TradeInTune, such as a display name, a short bio, a profile picture, and support messages ("User Content"). You keep ownership of your User Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and use it for the purpose of operating and improving the service. You are responsible for your User Content and confirm that you have the right to submit it and that it does not infringe anyone else's rights or break any law.
Zero tolerance for objectionable content and abusive users. You must not submit User Content that is unlawful, threatening, abusive, harassing, defamatory, hateful, sexually explicit, obscene, or that impersonates another person. You must not use your display name, bio, or profile picture to harass, deceive, or offend. We have zero tolerance for objectionable content and for abusive behaviour towards other users.
How to report or block someone. In the app, press and hold anyone on the leaderboard and choose Report or Block. Blocking is instant and private: they disappear from your leaderboard straight away, they are never told, and you can undo it in Settings → Blocked accounts. You can also email support@tradeintune.com.
We review every report and act on the ones that need it, normally within 24 hours. We may remove or hide the content, suspend the account, or terminate it permanently and without notice. An account terminated for objectionable content or abuse is not eligible for a refund.
We respect intellectual property rights and expect our users to do the same. If you believe content on TradeInTune infringes your copyright, send a notice to legal@tradeintune.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work you say has been infringed; (c) identification of the material you say is infringing and where it is located on the service; (d) your contact details; (e) a statement that you have a good faith belief the use is not authorised by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on their behalf.
We will remove or disable access to material we determine to be infringing, and we may suspend or terminate the accounts of repeat infringers. If you believe your content was removed by mistake, you may send a counter-notice to the same address with the equivalent information. Our designated contact for copyright notices is legal@tradeintune.com.
9. Third-party services
Some features rely on third parties: Stripe for payments, Google for sign-in, plus hosting and analytics providers. Their terms and privacy policies apply when you interact with them. We are not responsible for their services.
If you downloaded the app from the Apple App Store, the following additional terms apply and take priority over anything in these Terms and Conditions they conflict with, solely for the App Store version of the app. This agreement is between you and TradeInTune, not Apple, and Apple has no responsibility for the app or its content. Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any warranty, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no other warranty obligation, and any other claims, losses, or damages relating to a warranty failure are governed solely by these Terms and Conditions. Apple is not responsible for product liability claims, claims that the app fails to meet a legal or regulatory requirement, or consumer-protection claims relating to the app — we are solely responsible for those. Apple is also not responsible for investigating, defending, or settling any third-party claim that the app infringes their intellectual property rights — we are solely responsible for that too. You must comply with any applicable third-party agreement (for example, your wireless data plan) when using the app. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and Conditions, and Apple has the right to enforce them against you.
10. Disclaimers
The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy of content, and uninterrupted availability.
Nothing in these terms limits rights you have under Australian Consumer Law or any equivalent consumer-protection legislation that cannot be excluded by contract.
The financial-content disclaimers (risk warnings, past-performance language, simulated-drill disclosures, tax, and country-specific regulatory notices) are set out in full on our Disclaimer page and are incorporated by reference into these terms.
11. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
We are not liable for trading losses, missed opportunities, indirect damages, loss of profits, or loss of data, whether based in contract, tort, or any other legal theory.
12. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless TradeInTune, and its operator, contractors, and suppliers, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) your use of the service; (b) your breach of these terms; (c) your User Content; or (d) your violation of any law or of any third party's rights. We may assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with us. This clause does not require you to indemnify us for our own negligence or wilful misconduct, or to give up any right you have under a law that cannot be excluded by contract.
13. Dispute resolution and arbitration
Most issues can be sorted out quickly. Before starting any formal proceeding, you agree to first contact us at legal@tradeintune.com and give us 30 days to try to resolve the matter informally.
To the extent permitted by the law that applies to you, any dispute arising out of or relating to these terms or the service that is not resolved informally will be settled by final and binding individual arbitration rather than in court, except that either party may instead bring an individual claim in a small-claims court. Any arbitration will be conducted on an individual basis only.
Class-action waiver. To the extent permitted by the law that applies to you, you and TradeInTune each agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
Nothing in this section stops either party from seeking urgent injunctive relief in a court, and nothing in this section limits any right you have under a consumer-protection law that cannot be excluded by contract, including the Australian Consumer Law. Where a mandatory law that applies to you does not permit binding arbitration or a class-action waiver, this section does not apply to you to that extent, and section 16 (Governing law) governs.
14. Termination
You can close your account at any time from the account settings. We can suspend or close accounts that breach these terms, without prior notice where the breach is severe.
On termination, your access ends. Clauses that by their nature should survive termination (IP, disclaimers, limitation of liability, governing law) continue to apply.
15. Changes to these terms
We may update these terms. Material changes will be notified by email or in-product banner at least 14 days before they take effect. Continuing to use TradeInTune after the effective date means you accept the new terms.
16. Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in the courts of New South Wales, unless your local consumer-protection law requires otherwise.
